The Collection Process
 
If you have not received payment from a customer or borrower on a debt that is is rightly owed to you, Jonathan B. Vivona, PLC can assist you in collecting this debt.  The first step in collecting a past due account is to file a lawsuit in the applicable general district court or circuit court in the Commonwealth of Virginia so you can obtain a judgment in the full amount of the debt.
 
Once you have obtained judgment, meaning that a Court has held that the person does indeed owe you the money, you can proceed to take post-judgment collection action against them.
 
Due to our practice in bankruptcy law, Joanathan B. Vivona, PLC understands the ins and outs of collections and tracking a debtor's assets such as bank accounts, real property, wages and other income.  We can help you pursue the remedies that are available to creditors under Virginia law to obtain payment of a judgment.  We will also ensure that you are in compliance with federal statutes governing the collection of debt like the Fair Debt Collection Practices Act (FDCPA), Fair Credit Reporting Act (FCRA) and Bankruptcy Code (my favorite) by following all applicable collection laws and procedures.
